Notifications tighten payment options under DTH guidelines

NEW DELHI: In a move aimed at ensuring speedy realization of licence fee, the direct-to-home (DTH) Guidelines have been amended to provide for the first payment of the annual license fee (equivalent to 10 per cent of the gross revenue) on the basis of provisional accounts for the Financial Year certified by the Statutory Auditors, within one month of the end of that year.

 

The Guidelines had hitherto stated that the amount would be paid on the basis of the ‘audited accounts of the Company for that particular financial year’.

The amendment notified by the Information and Broadcasting ministry recently also says that the ‘annual License fee for the financial year shall be finally determined on the basis of final annual accounts of the FY audited by the Statutory Auditors, which shall not be later than 30 September of the following FY.’

If this amount is found to be higher than the amount already deposited, the difference amount along with simple interest at the rate of one per cent per month on the difference for the period of delay calculated from 1 May of the following FY upto and including the date of such payment shall be paid in one lumpsum within a period of 15 days from the date of finalization of audited accounts, or 15 October of the following FY whichever is earlier.

 
However, if the total annual fee deposited is more than the amount determined on the basis of audited accounts of the FY, the difference may at the request of the licensee be adjustable against the annual licence fee due for the following financial year.

Meanwhile, another notification issued recently mandates that the Lok Sabha TV and the Rajya Sabha television channels operated by Parliament have to be carried by DTH Platforms on the prime band in all bouquets.
